America is going through an interesting and exciting time right now for the cannabis sativa plant, at both the state and federal levels — things are happening fast so it’s easy to ask yourself are hemp cigarettes legal in my state?
Interestingly enough, while only some states have legalized recreational and medical marijuana, the hemp plant is perfectly legal to farm and smoke!

However, as far as we know, there are a few states that allow hemp cultivation, sale, and use without any problems or regulation, though some are still working out the details in their state congress, such as deciding whether to require labels on all CBD products, to allow or disallow CBD in food and beverage products, and just general discussion about how exactly to regulate CBD. The funny thing is that there are no known adverse affects to CBD hemp!
Here are those states below (and to be perfectly honest, you should really consult your state government’s website — if there’s a law against it, they will be clear about it).
States Where CBD Hemp Regulation Exists Or Are In Process:
- Rhode Island
- South Carolina
- New Hampshire
- New York
- North Carolina
- West Virginia
If you don’t see your state on this list, that means we didn’t see anything about regulations on CBD in your state.
Interestingly enough, most states that have regulated CBD hemp simply want labels or no CBD-infused food and beverages. There seems to be NO STATE on this list that cares about smoking hemp cigarettes besides Kentucky, Louisiana and Indiana.
Despite making it illegal to smoke hemp, one of the first states to begin developing a hemp industry in general was Kentucky. It’s clear that the state sees the value in hemp for paper, rope, and various other products — even CBD — as they have no other regulations regarding consumable CBD (besides tea, for some reason).

Although it was not until recently that the cigarette companies started producing hemp flavored cigarettes in the United States, these flavored cigarettes have been around for quite some time now. A lot of the time, tobacco companies add herbal extracts to cigarettes as a way to improve the flavor. There are also some times when people will even burn hemp seeds in their own cigarettes to create a unique blend of flavors.
Hemp cigarettes are not only popular with smokers, they are also becoming popular with non-smokers. Since they have less tar and nicotine than regular cigarettes, hemp cigarettes can actually help you quit smoking without taking any pills, patches, or gum!
